Background: The Opium Crisis in Colonial Philippines

When the United States acquired the Philippines in 1898, American administrators inherited a complex opium situation from the Spanish colonial government. Under Spanish rule, opium was legal and regulated through a system of <b class="lt-bold">tax farming</b>, where the government granted monopolies for opium sales in specific regions, generating substantial colonial revenue. However, this system was restricted to the Chinese community - ethnic Chinese residents could legally purchase and consume opium, while Filipinos were prohibited from doing so.

The American military government initially abolished the Spanish opium farms in favor of a high tariff system, but this approach proved problematic. By 1903, several concerning trends had emerged: opium imports were steadily increasing despite the high tariffs, the habit of opium smoking was spreading from the Chinese community to the Filipino population, and the prohibitive tariff rates were encouraging widespread smuggling.

The Philippine Opium Commission of 1903
</h2>
<p>
Recognizing the growing crisis, Civil Governor <a href="https://kahimyang.com/kauswagan/articles/1717/september-15-1857-william-howard-taft-first-civil-governor-of-the-philippines-was-born-at-cincinnati-ohio" class="news_link">William Howard Taft</a> appointed a special commission in 1903 to investigate opium policies throughout Asia and recommend the best approach for the Philippines. This commission consisted of three members:

<b class="lt-bold">Dr. José Albert</b>, a prominent Filipino physician from Manila

<b class="lt-bold">Bishop Charles Henry Brent</b>, Protestant Episcopal Bishop of the Philippines and a vocal opponent of opium legalization
</li>
</ul>
<p>
The commission conducted an extensive survey of opium policies across Asia, visiting Hong Kong, Shanghai, French Indochina, Japan, Formosa (Taiwan), the Dutch East Indies, Singapore, Burma, and studying the British Royal Commission's report on opium use in India. Their comprehensive report, completed by March 1904, labeled opium use as "one of the gravest, if not the gravest moral problems of the Orient".

The commission was particularly impressed with the Japanese approach in Formosa (Taiwan), which involved a government monopoly system that gradually phased out opium use leading to ultimate prohibition for non-medicinal purposes. They recommended adopting this model for the Philippines.

Missionary Opposition and Political Pressure
</h2>
<p>
The commission's initial recommendation to return to a modified opium farm system sparked intense opposition from American Protestant missionaries in the Philippines and their supporters in the United States. Led by figures like <b class="lt-bold">Reverend Wilbur F. Crafts</b> of the International Reform Bureau, missionary groups launched a coordinated campaign of letters, cables, and petitions to the federal government, arguing that legalizing opium contradicted American moral values.

<p>
This pressure campaign proved successful. President <a href="https://en.wikipedia.org/wiki/Theodore_Roosevelt" class="news-link-ext" target="_blank" rel="noreferrer">Theodore Roosevelt</a> intervened, and the War Department reversed its initial position, cabling the Philippine Commission to "hold opium monopoly bill, further consideration; many protests". The sustained missionary opposition ultimately led to a more restrictive approach that emphasized prohibition rather than regulation.

Key Provisions of Act No. 1761
</h2>

The 1907 opium law was remarkably comprehensive, establishing a detailed regulatory framework that included:

Registration and Licensing System
</h3>

Only Chinese residents who were habitual opium users could register for legal use
</li>
<li>
Certificates specified the permitted daily quantity for each registered user
</li>
<li>
The Collector of Internal Revenue was required to reduce the allowed daily quantity by 15% each month starting November 1907, leading to gradual elimination
</li>
<li>
Registration fees were set at escalating rates to discourage new users
</li>
</ul>

Strict Possession and Use Controls
</h3>

All dispensaries had to display clear signage identifying themselves as licensed opium establishments
