UPROAR! Graft court upholds Garcia plea bargain, calls prosecution evidence 'deficient'

CITING full compliance by the defendant with all conditions, the Sandiganbayan Second Division yesterday approved the plea bargain agreement between Maj. Gen. (ret.) Carlos F. Garcia and the Office of the Ombudsman allowing the former AFP comptroller, his wife Clarita, and sons Ian Carl, Juan Paulo and Timothy Mark to walk on plunder charges.

In a 22-page resolution penned by Associate Justice Teresita V. Diaz-Baldos, the graft court declared itself satisfied with Garcia’s turnover to the government of P135.43 million in assets, including P52.51 million cash from bank deposits, P21.27 million worth of real estate properties located in the country, a P43.15-million condominium in New York, seven motor vehicles with a total assessed value of P4.42 million, and proceeds of two bank accounts in the United States totaling P13.85 million.

The court said the prosecution presented "deficient evidence" in the plunder case which made Garcia’s conviction "questionable and shaky."
