Under the Spanish regime, the union of Church and State was absolute. The Spanish Crown acted as the patron of the Catholic Church in the colonies, and in return, the Church administered many functions that we now associate with the government. Foremost among these was the regulation of marriage.

The decrees of the Council of Trent, a major ecumenical council of the Catholic Church held in the 16th century, were elevated to the status of civil law in the Philippines. This meant that for a marriage to be valid, it had to be performed by a Catholic priest, in the presence of witnesses, and in accordance with the rites of the Church. The State simply enforced what the Church decided. If the Church said a couple was married, the State recognized it. If the Church annulled a marriage, the State recognized that too.

This system placed immense power in the hands of the parish priest. He controlled the registry of births, marriages, and deaths. He determined who was eligible to marry and who was not. For the vast majority of Filipinos, there was no alternative. A couple could not go to a judge or a mayor to get married. There was no "City Hall" wedding. It was the Church or nothing.

The Failed Attempt at Reform: The Law of 1870
</h3>
<p>
There was one brief flicker of secularism before the Americans arrived. In 1870, a Civil Marriage Law was passed in Spain, influenced by the liberal political movements in Europe. This law attempted to introduce civil marriage to the colonies. However, the implementation of this law in the Philippines was actively resisted by the conservative elements of the colonial government and the clergy.

Legal historians note that while the law technically existed on paper, it was effectively suspended. The power of the Friar orders - the Augustinians, Dominicans, Franciscans, and Recollects - was so entrenched that they successfully blocked the enforcement of any law that threatened their jurisdiction over the family. Consequently, when the Americans arrived in 1898, the Canon Law was still, for all practical purposes, the only law of the land regarding marriage.

The Legal Status of Divorce Under Spain

Perhaps the most significant feature of the Spanish system was the indissolubility of marriage. Following Catholic dogma, a valid marriage could never be broken by anything other than death. The concept of absolute divorce (divorce a vinculo matrimonii), which allows spouses to remarry, was unknown.

The only remedy available to unhappy couples was divorce a mensa et thoro (separation from bed and board). This was governed by the Siete Partidas, a 13th-century legal code from Castile. This law allowed spouses to live apart if one committed adultery or joined a religious order, but it did not break the marital bond. They remained legally married and could not remarry. This legal reality created a society where marital status was rigid, permanent, and entirely subject to ecclesiastical oversight.

The outbreak of the Spanish-American War in 1898 and the subsequent Treaty of Paris transferred sovereignty over the Philippines to the United States. This transfer brought with it a collision of legal philosophies. The United States was built on the principle of the separation of Church and State, a concept diametrically opposed to the Spanish model.

It was a direct command from the military governor intended to create a new "marriage law" for the islands.
